1.1. The data controller

Clean Power is the data controller of your personal data. We determine what data is collected, the purposes for which it is processed and the technical and organisational resources for processing it.

1.2. The data processor

Clean Power is entitled to use one or more data processors. A data processor is the natural or legal person which processes your personal data at the request of and on behalf of Clean Power, the data controller. The data processor is required to ensure the security and privacy of your data and always acts on instructions from Clean Power.

We process your data on the following legal grounds:

• the fulfilment of pre-contractual measures and the performance of the contract to which you are a party, with regard to the use and provision of our services.
• the performance of the contract to which you are a party and pursuant to our legal obligations, with regard to the management of the contractual relationship and invoicing.
• your consent to the sending of promotional offers (direct marketing).

The processing of your personal data is limited to that which is strictly necessary for the purposes specified by Clean Power (see Point 4 below). The following data is collected and processed:

• Your first name, surname and address
• Your email address
• Your phone number
• Information about to your connection (IP address, location, etc.).

We do not collect or process sensitive data under any circumstances.

This data is collected when you visit the website, fill in our contact form or contact us by email. Other personal data may be collected at a later date such as when fulfilling your order, for example. This data is necessary for the provision of our services.

7.1. Guarantee of fair and lawful processing

Your personal data will always be processed in accordance with the legitimate purposes set out in Point 4. It is collected and processed in an appropriate, relevant and non-excessive manner and is kept for no longer than is necessary for the purposes for which it is to be used.

7.2. Right of access

If you are able to prove your identity, you have the right to obtain information about the processing of your data. You therefore have the right to know the purposes of the processing, the categories of data in question, the categories of recipients to whom the data is transferred, the criteria used to determine how long the data is kept and the rights you can exercise regarding your data.

7.3. Right to rectification

Inaccurate or incomplete personal data may be corrected at any time, on written request.

7.4. Right to erasure (right to be forgotten)

You also have the right to have your personal data erased in the following circumstances:

• Your personal data is no longer required for the purposes for which it was collected;
• You withdraw your consent for the data to be processed and there is no other legal basis for the processing;
• You have legitimately exercised your right to object;
• Your data has been processed unlawfully;
• Your data must be deleted to comply with a legal obligation.

As the erasure of data is primarily a matter of visibility, it is possible that erased data may still be kept temporarily.

7.5. Right to limit the processing of your data

In certain cases, you have the right to request the restricted processing of your personal data, particularly in the event of a dispute as to the accuracy of the data, if the data is required in the context of legal proceedings or for the time necessary for Clean Power to verify that you can legitimately exercise your right to erasure.

7.6. Right to object

You also have the right to object at any time to the processing of your personal data for direct marketing purposes. Clean Power will no longer process your personal data, unless it can demonstrate compelling legitimate grounds for doing so which override your right to object.

7.7. Right to the portability of data

You have the right to obtain all the personal data you have provided us in a structured, commonly used and machine-readable format. At your request, this data may be transferred to another service provider, unless this is technically impossible.

7.8. Right to withdraw your consent

You may withdraw your consent to the processing of your personal data, such as for direct marketing purposes, at any time.

To exercise your rights, you must send us a written request and proof of identity by registered letter to Clean Power SA, rue Emile Francqui 2, 1435 Mont-Saint-Guibert or by email: [email protected]. We will respond as soon as possible, no later than one (1) month after receipt of your request.

If you are not satisfied with the way your personal data has been processed by Clean Power, you have the right to make a complaint with the Belgian Data Protection Authority (https://www.autoriteprotectiondonnees.be/citoyen).
